By using our website or engaging our services, you agree that the responsibility of Zeltra Works is limited to the maximum extent permitted by applicable law.

Construction and engineering-related projects involve substantial uncertainty, third-party performance, changing costs, site conditions, legal requirements, permitting procedures, inspection outcomes, and physical work outside the direct control of Zeltra Works. This policy is designed to clearly define the boundaries of our role as an online consulting and remote project support provider.

1. Advisory Nature of Services

Zeltra Works provides advisory, planning, estimation, remote management, documentation, and consulting support. Our services are based on the information provided by the client, available project documents, stated assumptions, and professional judgment at the time the work is performed.

Our recommendations are not guarantees. They are intended to assist with planning, communication, cost review, schedule organization, and project decision-making. Clients remain responsible for reviewing all information, confirming assumptions, consulting licensed professionals where required, and making final decisions.

2. No Liability for Construction Outcomes

Zeltra Works is not liable for final construction outcomes, including project delays, cost overruns, contractor mistakes, design changes, inspection failures, permitting issues, site conditions, safety incidents, labor shortages, material shortages, or changes in market pricing.

• Actual construction costs may differ from estimated costs.
• Project schedules may change due to weather, permits, labor, suppliers, inspections, or contractor performance.
• Contractors may perform work differently from the client’s expectations.
• Site conditions may require changes that were not visible in submitted documents.
• Regulatory or code requirements may change or be interpreted differently by authorities.

3. Exclusion of Certain Damages

To the maximum extent permitted by law, Zeltra Works shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages. This includes damages that may arise from business disruption, loss of revenue, loss of profit, loss of opportunity, increased project cost, delay, reputational harm, financing issues, or third-party claims.

These limitations apply even if Zeltra Works has been advised that such damages may occur. They also apply to claims based on contract, tort, negligence, strict liability, warranty, statute, or any other legal theory.

4. Maximum Liability

To the maximum extent permitted by applicable law, the total aggregate liability of Zeltra Works for any claim related to a service shall not exceed the amount actually paid by the client to Zeltra Works for the specific service giving rise to the claim.

If the claim relates to a specific phase, package, invoice, milestone, or deliverable, liability shall be limited to the amount paid for that specific phase, package, invoice, milestone, or deliverable, not the total value of the broader construction project.

5. Third-Party Liability

Zeltra Works is not responsible for the actions or omissions of contractors, subcontractors, engineers, architects, inspectors, suppliers, consultants, government agencies, payment processors, software providers, or other third parties. Any dispute with a third party must be addressed directly with that third party.

6. Client-Provided Information

Zeltra Works relies on information provided by the client and third parties. We are not liable for errors, omissions, inaccurate estimates, incorrect assumptions, or project issues caused by incomplete, inaccurate, outdated, misleading, or delayed information.

The client is responsible for verifying the accuracy of measurements, drawings, budgets, site information, contractor details, legal requirements, and project assumptions before relying on any deliverable.

7. No Liability for Client Decisions

Clients remain solely responsible for final decisions. This includes decisions related to hiring contractors, approving budgets, purchasing materials, modifying designs, proceeding with construction, accepting bids, submitting permits, or implementing recommendations.

8. Website Use

Zeltra Works is not liable for damages arising from website use, website errors, temporary unavailability, technical issues, third-party links, browser incompatibility, data transmission problems, or reliance on general website content.

9. Legal Limits

Some jurisdictions may not allow certain limitations or exclusions of liability. In such cases, the limitations in this policy will apply only to the maximum extent permitted by law. Any unenforceable provision shall be interpreted in a manner that most closely reflects the original intent while remaining enforceable.
